1. Types of Information Collected
SchoolBoost may collect personal information that you supply when you sign up for an account to become a Member or otherwise communicate with the Site. Such personal information includes the your name, postal address, telephone number, fax number, and e-mail address.
SchoolBoost may also automatically collect non-personal information from users of the Site, such as the IP address of the computer through which the users access the Site, the physical location of that IP address, and the type of web browser being used to access the Site. SchoolBoost may also place a “cookie” on your hard drive when you access the Site. A cookie is a small piece of data that collects information about how you use the Site, what pages are viewed, and what information is accessed. SchoolBoost uses this non-personal information to understand users’ needs and most effectively administer the Site and Service in response to those needs.
This Site is directed to and intended for use by adults only. SchoolBoost requires that a user be at least eighteen years of age or older to submit personally identifiable information. As such, SchoolBoost does not knowingly collect or distribute any personally identifiable information from minors through the Site.
2. Use of Information Collected
SchoolBoost will not sell or share Members’ personal information with unrelated third parties, partners or affiliates unless the Member consents to the disclosure, or except as may be required by law, governmental authority or to cooperate with law enforcement authorities.
PLEASE NOTE, HOWEVER, THAT IF YOU BECOME A MEMBER OF THE SITE AND POST A MESSAGE ON A BULLETIN BOARD, CHAT ROOM, FORUM, AND/OR OTHER COMMUNITY AREA ON THE SITE, YOU AGREE AND CONSENT TO THE DISPLAY OF YOUR USER NAME AND EMAIL AND/OR PHONE NUMBER ALONG WITH YOUR POSTING. NO OTHER PERSONAL INFORMATION WILL BE DISPLAYED. This limited disclosure of personal information is to facilitate the dissemination of information about and experiences with schools. Users may wish to contact the Member behind a post directly to seek more information or clarification about a post.
Any additional information a Member puts in a post becomes public information which can be viewed by any user of the Site. Thus, you should exercise caution when deciding to disclose personal, financial, or other types of sensitive information in the publicly accessible areas of the Site. You use such community functions at your own risk.
SchoolBoost may combine your usage information for the Site and Service with that of other users to determine which areas of the Site and which Services are most popular. By collecting and analyzing this data, SchoolBoost can improve the Site and Services. This “aggregate information” does not contain any of your personally identifiable information.
3. Protection and Modification of Personal Information
The protection of your personal information is important to SchoolBoost, and SchoolBoost will take reasonable measures to ensure its safekeeping. However, no transmission of data over the internet can be guaranteed to be 100% secure. The personal information you provide to SchoolBoost in your Member account is password protected, so only the Member can access or change the personal information. You should not share the password to your account with anybody. You are responsible for the maintenance and accuracy of the information in your account profile. You can update your personal information at any time by clicking on “update profile” link when signed into your personal account.
4. Links to Third Party Websites
The Site may feature links to third party websites that offer goods, services, or information. SchoolBoost is not responsible for the information collection practices of these third party websites. It is your responsibility to review the privacy policies of the third party websites before using them.
SchoolBoost does not represent or warrant that the information accessible via the Site (including links to third party websites) is accurate, complete or current. SchoolBoost accepts no responsibility or liability whatsoever with regard to the information on this site. The service provided by the Site (“Service”) is provided on an “as is” and “as available” basis.
SchoolBoost expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. Any material streamed, viewed, downloaded, or otherwise obtained through the use of the Site is done at your own discretion and risk. You expressly agree that you will be solely responsible for any damage to your computer system or loss of data that results from your access to such material.
2. Use of Service
The Service is not available to minors under the age of 18 or to any users suspended or removed from the system by SchoolBoost for any reason.
To the extent that the Service includes forms, documents, or software to be downloaded to your computer (collectively, “Software”), the Software is considered part of the Service, and you may use the Software on a computer system only if you own the system or have the permission of the owner. You may not alter the Software or associated data files. Distribution of the Software is prohibited.
Users of the Site can become Members with the ability to use the bulletin boards to post information and to reply to posted information. In order to become a Member, users must set up an account with SchoolBoost.
3. Member Account, Password and Security
You will be required to create an account with a distinct user identification (“user id”) and password to post to the bulletin boards. You are responsible for maintaining the confidentiality of your user id and password, and are fully responsible for all activities that occur under your user id or account. You agree to: (a) immediately notify the Site of any unauthorized use of your user id, password, or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. SchoolBoost cannot and will not be liable for any loss or damage arising from your failure to comply with this Section.
4. User and Member Conduct
You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials (“Content”), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not the Site, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service. The Site does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will the Site be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service.
5. Monitoring and Enforcement
While SchoolBoost has the right to monitor activity and content associated with the Service, it is not obligated to do so. And since it does not, and may not have the ability to, control or actively monitor content, SchoolBoost does not guarantee its accuracy, integrity or quality. SchoolBoost may investigate the complaints and violations of its policies that come to its attention and may take any action that it believes is appropriate, including, but not limited to issuing warnings, removing the content or terminating accounts and/or subscriptions. However, because situations and interpretations vary, SchoolBoost also reserves the right not to take any action.
6. Intellectual Property Ownership and Rights
SchoolBoost owns and/or licenses all right, title and interest in and to the Service and all materials and content contained therein, including, without limitation, site design, logos, button icons, images, digital downloads, data compilations, text, and graphics. All such materials and content are protected by copyright, trademark and other intellectual property laws. Any unauthorized use of the materials provided as part of the SchoolBoost Service is strictly prohibited.
If you post any Content to the Service you hereby grant SchoolBoost and its affiliates and licensees a worldwide, royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, publicly display, publicly perform, modify, sublicense and distribute such Content, and incorporate it in other works, in whole or in part, in any manner and any media now known or hereafter developed. You represent and warrant that you own such Content or otherwise have sufficient rights in the Content to grant SchoolBoost the license set forth in this section without infringing or violating the rights of any third party.
7. Links to Third Party Content
SchoolBoost provides links to third party websites for your convenience only. SchoolBoost does not endorse, recommend or provide any warranties regarding the third party websites, or the services provided therein. You agree that SchoolBoost has no obligation to review any of the third party links or sites and is not responsible for any content of any of the linked sites.
In its sole and absolute discretion, with or without notice to you, SchoolBoost may (1) suspend or terminate your use of the Service, or (2) terminate your account. You may terminate your account for any reason by contacting SchoolBoost at email@example.com. SchoolBoost shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension of the Services.
10. Limitation on Liability
YOU EXPRESSLY UNDERSTAND AND AGREE THAT SchoolBoost SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF THE SITE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.
11. Applicability of Disclaimers; Exclusions and Limits
BECAUSE SOME JURISDICTIONS DO NOT ALLOW FOR THE EXCLUSION OF DAMAGES, SchoolBoost’S LIABILITY IN SUCH JURISDICTIONS SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY THE LAW OF SUCH JURISDICTION. IN ADDITION, BECAUSE SOME JURISDICTIONS DO NOT PERMIT THE DISCLAIMER OF CERTAIN WARRANTIES, THE DISCLAIMERS SET FORTH ABOVE MAY NOT APPLY TO YOU.
